Area Man Accused of Rape of Unconscious Teen Due Back in Court Next Week

OILCREEK TWP., Pa. (EYT) — A Titusville man accused of the rape of an unconscious teen at an Oilcreek Township residence late last year is due back in court next week.

According to court documents, a hearing for 19-year-old Devon Charles Johnson on Wednesday, June 3, was continued and is scheduled to resume at 1:30 p.m. on Wednesday, June 10.

Johnson faces the following charges:

– Rape Unconscious Victim, Felony 1
– Unlawful Contact With Minor — Sexual Offenses, Felony 1
– Corruption Of Minors — Defendant Age 18 or Above, Felony 3
– Indecent Assault Person Unconscious, Misdemeanor 1

He is currently lodged in the Venango County Jail on $50,000.00 monetary bail.

The charges stem from an incident that occurred in October of 2019.

Details of the case:

According to a criminal complaint, Trooper Haun, of PSP Franklin, interviewed the known teen at her residence on October 29 around 7:35 a.m. The teen reported that she was at a Halloween party at a residence in Oil Creek Township on the night of October 26 through the morning of October 27. The victim told Trooper Haun that she gave a statement at the hospital on October 27 when she consented to a sexual assault examination and that she remembered more from the incident.

The victim told Trooper Haun that she was “drunk” and went to a bedroom to sleep. She stated that she was sleeping on an air mattress and woke up to Devon Charles Johnson saying: “I am going to lay here, is that okay?” The victim said that she didn’t respond to the question and rolled over and went back to sleep, according to the complaint.

The victim reported she awoke later to Johnson having sexual intercourse with her while she slept, without her consent. She stated that she asked Johnson what he just did, and Johnson replied, “What?” as if he did nothing wrong and it was a “normal act” that she wanted, according to the complaint.

Johnson was also interviewed.

According to the complaint, Johnson stated that he was at the party on the night in question. When questioned about the night, Johnson told police he drank approximately 14 beers that night and said: “I was pretty gone.” He stated the victim “flirted” with him at one point in the night but went on to say he did not dance or talk to her.

When asked where he slept, Johnson said: “in a spare bedroom at the top of the steps to the left” and reported he slept on an air mattress. He told police that he remembered two other known individuals being in the room at one point, but he did not believe anyone else slept in the room that night, the complaint states.

When asked if he had done anything sexual with the victim, Johnson said “no,” the complaint indicates.

The accused gave a DNA sample via buccal swab without incident.

On May 21, police received the serology lab report from the Pennsylvania State Police Bureau of Forensic Services Erie Regional Laboratory related to the investigation. The lab report stated seminal material was identified in the victim’s underwear, and analysis of the DNA in the material found it matched DNA from saliva acquired from Johnson, according to the complaint.

Court documents indicate Johnson was arraigned in front of Judge Kirtland at 12:30 p.m. on Friday, May 29.
