Clarion County Man Arrested for Sexual Assault of Underage Girl

CLARION CO., Pa. (EYT) — A Clarion County man was arrested on Monday afternoon on charges related to the sexual assault of an underage girl.

Court documents indicate the Clarion-based State Police filed the following charges against 46-year-old Robert Scott MacKinlay, of Rimersburg:

  • Statutory Sexual Assault: 11 Years Older, Felony 1
  • Sexual Assault, Felony 2
  • Aggravated Indecent Assault — Complainant Less Than 16, Felony 2
  • Corruption Of Minors — Defendant Age 18 or Above, Felony 3
  • Indecent Assault Person Less 16 Yrs Age, Misdemeanor 2

According to a criminal complaint, on December 10, 2017, Trooper Berggren, of the Clarion-based State Police, was contacted by a Clarion State Police Communications Operator to respond to the Clarion Hospital Emergency Room to interview a sexual assault victim.

Trooper Berggren arrived at the hospital and was met by an emergency room physician and multiple staff members who related that a known 14-year-old female had been brought to the hospital for a sexual assault examination.

According to the complaint, the staff advised Trooper Berggren that the victim had disclosed that she had been watching movies with Robert MacKinlay while sitting on a bed. The victim related that she and MacKinlay had been drinking alcoholic beverages, including various wine coolers and shots of rum. She reported that she fell asleep and awakened to MacKinlay sexually assaulting her and was unable to move her body immediately.

The complaint notes that the victim consented to a sexual assault examination and authorized the release of evidence which enabled Trooper Berggren to take custody of the evidence collection kit.

According to the complaint, the comparison yielded positive results for a DNA match between the evidence found in the sexual assault kit and the submitted DNA from MacKinlay.

The complaint states that MacKinlay denied any request to be interviewed by Trooper Berggren in relation to the incident.

Based on the investigation, MacKinlay was arraigned at 12:30 p.m. on Monday, December 3, in Magisterial District Judge Jeffrey C. Miller’s office.

Unable to post $50,000.00 monetary bail, he was lodged in the Clarion County Jail.

A preliminary hearing is scheduled for 1:15 p.m. on Tuesday, December 18, with Judge Miller presiding.
