Franklin Woman Living in Condemned Building Charged with Defiant Trespass

FRANKLIN, Pa. (EYT) – A Franklin woman is facing criminal charges after officers found her living in a building that had been condemned by the City.

According to court documents, the Franklin Police Department filed criminal charges against 72-year-old Anna Marie Mudry, of Franklin, on August 22.

The charges stem from a report of a trespass violation at 1003 Elm Street, Franklin, Venango County, on August 20.

Patrolmen Wheeling and Floor were dispatched to the above-described location around 1:07 p.m. on Tuesday, August 20. The officers were already aware that the residence was condemned by the City of Franklin Code Enforcement and were aware that Anna Mudry lived in the residence, according to the complaint.

Officer made entry through a partially opened front stop door and observed Mudry inside the residence.

She was asked to exit the residence, and she complied.

Once outside, Patrolman Wheeling told Mudry that she was not permitted in the residence and explained to her that he knew she was advised by Code Enforcement and Lieutenant Campbell of this situation. Mudry stated that she was aware and agree. She later departed the area, and there were no further incidents on that date, according to the complaint.

The complaint also indicates that Anna Mudry had been warned and advised no less than three times by officials from Venango County City of Franklin Code Enforcement and officers from Franklin City Police Department that the residence is not structurally safe to enter or occupy and that she can be charged with trespass if she enters the residence.

The following charge was filed against Mudry in Magisterial District Judge Matthew T. Kirtland’s office on August 22:

A date for a preliminary hearing has not been set.
