Franklin Man Found Passed Out in Running Vehicle Facing Felony Drug Charges

FRANKLIN, Pa. (EYT) — A Franklin man who was found passed out behind the wheel of a running vehicle is facing felony drug possession and other related charges.

Court documents indicate that the Franklin-based State Police filed criminal charges against 42-year-old William Andrew Docherty of Franklin.

According to a criminal complaint, Trooper Owens was dispatched to the Kwik Fill on State Route 8 on Saturday, July 14, for a report of a male passed out in his vehicle.

Upon his arrival, Trooper Owens met Franklin Police Department officers already on the scene. Officer Lopez informed Trooper Owens that Docherty was found in the driver seat of the vehicle with the vehicle still running and “in gear.”

According to the complaint, Officer Lopez had Docherty exit the vehicle where he conducted a pat down for his safety and felt an unknown object in Docherty’s front pocket. Officer Lopez removed the object and discovered a clear baggie with suspected methamphetamine, which the complaint notes was later weighed at the station as 18.4 grams.

Trooper Owens made contact with Docherty and asked when he had last used methamphetamine and Docherty stated he had used “sometime last night” and said he could not remember how he got to Kwik Fill and why he was there, according to the complaint.

Trooper Owens then had Docherty perform a field sobriety test, which the complaint states Docherty could not complete as instructed or demonstrated.

The complaint also notes that the area where the vehicle had traveled off the road was clearly visible from the grass pressed down where the vehicle traveled over it.

Docherty was arraigned at 3:15 p.m. on Saturday, July 14, in Magisterial District Judge Andrew F. Fish’s office on the following charges:

  • Possession of Controlled Substance, Felony
  • Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony
  • DUI: Controlled Substance — Schedule 1 — 1st Offense, Misdemeanor
  • DUI: Controlled Substance — Impaired Ability — 1st Offense, Misdemeanor
  • Careless Driving, Summary

Unable to post $25,000.00 monetary bail, he was lodged in the Venango County Jail.

A preliminary hearing is scheduled for 8:30 a.m. on Wednesday, July 18, with Judge Fish presiding.
