Couple Facing Charges for Theft, Use of Debit Card

OIL CITY, Pa. (EYT) — A local couple is in hot water after they allegedly used a woman’s debit card to make unauthorized purchases.

Court documents indicate the Oil City Police Department filed criminal charges against 33-year-old Kyle Benjamin Tracy, of Oil City, and 29-year-old Mary Katherine Coulter, of Titusville.

According to a criminal complaint filed by Oil City Patrolman Byham, around 11:47 a.m. on April 1, a known female called to report that Kyle Tracy stole her income tax return debit card.

According to the complaint, the victim told police that she asked Tracy to go to the store for her and told him he was only permitted to use the card to get her a drink and potato chips; however, Tracy never returned with the items or the card. The victim said her card was also used at an ATM where she believes Tracy withdrew $400.00.

Police reviewed video footage from the store on the night the card was used.

According to the complaint, the footage shows Tracy and his girlfriend — Mary “Katie” Coulter — using the victim’s card. The first purchase was made by Coulter for $18.55 around 2:39 a.m. on April 1, and the second purchase was made by Tracy at 2:42 a.m. for $5.71.

The complaint notes additional footage showed Tracy walking to an ATM around 10:45 a.m. on April 1, and making a withdrawal of $400.00.

According to the complaint, the victim confirmed that she only gave Tracy permission to use the card to get her a drink and potato chips. The victim was able to positively identify both Tracy and Coulter from the video footage.

Charges were filed against both Tracy and Coulter through Magisterial District Judge Andrew F. Fish’s office on April 16.

Tracy faces the following charges:

– Other Reason Access Device Is Unauthorized By Issuer, Misdemeanor 1
– Other Reason Access Device Is Unauthorized By Issuer, Misdemeanor 2
– Criminal Conspiracy Engaging — Other Reason Access Device Is Unauthorized By Issuer, Misdemeanor 2
– Theft By Unlawful Taking-Movable Property, Misdemeanor 2

Coulter faces the following charges:

– Other Reason Access Device Is Unauthorized By Issuer, Misdemeanor 2
– Criminal Conspiracy Engaging — Other Reason Access Device Is Unauthorized By Issuer, Misdemeanor 2

Preliminary hearings for both defendants are scheduled for 8:30 a.m. on Wednesday, May 22, with Judge Fish presiding.

Certified summons were issued on April 16.
