Franklin Man Accused of Attacking Officer Waives Hearing on Assault Charges

FRANKLIN, Pa. (EYT) — A Franklin man waived his preliminary hearing on Aggravated Assault and related charges stemming from a May 6 incident in which he allegedly attacked a police officer and threatened to kill him and others.

According to court documents, the following charges against 39-year-old Kevin Michael Whitman, of Franklin, have been transferred to Venango County Court of Common Pleas:

– Aggravated Assault, Felony 1
– Aggravated Assault, Felony 2 (two counts)
– Terroristic Threats With Intent To Terrorize Another, Misdemeanor 1 (two counts)
– Resist Arrest/Other Law Enforcement, Misdemeanor 2

Whitman waived the charges on Wednesday during a preliminary hearing before Magisterial District Judge Matthew T. Kirtland.

Whitman remains lodged in the Venango County Jail.

Details of the case:

According to a criminal complaint, on Sunday, May 6, Franklin Police officers were dispatched to a residence on the 200 block of Atlantic Avenue for a report of a suicidal male.

Upon arrival, officers met Kevin Whitman, who was covered in blood and sitting on the ground. Franklin Police had been advised that Whitman was attempting to injure family members with a boat motor, the complaint states.

According to the complaint, Whitman asked an officer to “put a bullet in his head,” and the officer told him that no one was going to do that. Whitman then stood up and allegedly charged the officer and spit in his face.

The officer then attempted to place Whitman under arrest.

The complaint states that Whitman allegedly became aggressive again and attempted to head-butt and spit on officers. Whitman had to be physically restrained.

According to the complaint, when an officer attempted to place Whitman in the patrol vehicle, Whitman again became combative, and officers had to physically place Whitman into the vehicle, where he continued to be noncompliant, kicking the windows and threatening the officer. Whitman allegedly told an officer that he would kill him, as well as his own family members.
