Franklin Man Accused of Indecent Assault, Theft

FRANKLIN, Pa. (EYT) – A Franklin man is facing multiple charges following an incident that occurred on Friday afternoon in Franklin.

According to court documents, the Franklin Police Department filed criminal charges against 51-year-old Richard Fowler, of Franklin.

According to a criminal complaint, around 8:04 p.m. on Saturday, February 10, Patrolman Floor was dispatched to a residence on Dale Avenue in Franklin for a report of a possible sexual assault.

Patrolman Floor spoke to a known victim who stated that at approximately 3:00 p.m. on Friday, February 9, Richard Fowler knocked at her door. She stated that Fowler told her that her fiancé said he could stay at their residence for a while. She called her fiancé and verified what Fowler had said. She told Patrolman Floor that later that day, Fowler told her that her fiancé said he could use their car. She tried to verify this with her fiancé but was unable to contact him. She allowed him to use the vehicle, the complaint states.

When Fowler returned, he allegedly had alcohol with him and began to drink. Fowler “started to get very rude, ignoring her and not allowing her to speak.” The victim told police “Fowler was ‘flirting,’ saying things like, ‘He’s so lucky to have you,’ and, ‘I want to put my face against your neck,'” the complaint states.

The victim asked Fowler to leave several times, “but Fowler got angry and began yelling at her, calling her a ‘controlling (expletive)’ and refusing to leave the residence.”

She said she was scared, so she went outside to her vehicle to get away from Fowler, since he would not leave.

The complaint states that “Fowler then came out and got into her vehicle where he proceeded to put his hand on the inside of her upper thigh and lick her ear. She said she then jumped out of the vehicle and told Fowler that if he did not leave, she would call police.”

The woman told Patrolman Floor that Fowler then began to gather his things and finally left the residence.

Based on the investigation, on February 10, the following charges were filed against Fowler at District Judge Matthew T. Kirtland’s office:

– Theft By Unlawful Taking-Movable Property, Felony 3
– Unauthorized Use Motor Vehicle/Other Vehicles, Misdemeanor 2
– Defiant Trespass Actual Communication To, Misdemeanor 3
– Indecent Assault-Without Consent Of Other, Misdemeanor 2

Fowler is awaiting a preliminary hearing.
