Franklin Man Faces DUI, Child Endangerment Charges

SUGARCREEK BOROUGH, Pa. (EYT) — A Franklin man is facing DUI and related charges stemming from an incident that occurred last month in Sugarcreek Borough, Venango County.

On December 15, the Sugarcreek Borough Police Department filed criminal charges in Magisterial District Judge Patrick E. Lowrey’s office against 36-year-old Judson Keith Davis, of Franklin.

According to a criminal complaint, on November 21, 2017, Sugarcreek Borough Patrolman Matthew Johnson was advised by 911 that PSP had a report of an erratic driver headed east on Route 322 from Meadville. Patrolman Johnson went to Route 322 and spotted the vehicle that matched the description given. He followed it at 88 mph in a posted and maintained 55 mph zone. He observing it crossing the center double yellow line and the fog line multiple times. The speed fluctuated constantly going anywhere from 65 mph to 70 mph. Nearing Franklin, the swerving was increasing, so Patrolman Johnson initiated a traffic stop, activating the vehicle’s lights and audible siren. The driver jerked the wheel and pulled off the side of the road into a parking lot.

The complaint states that upon approaching the vehicle, Patrolman Johnson could detect a strong odor of an alcoholic beverage coming from inside the vehicle. When he asked for the operator’s information, Patrolman Johnson learned that the driver’s license was suspended and that the driver’s name was Judson Keith Davis.

According to the complaint, Patrolman Johnson suspected that Davis was driving while under the influence of alcohol, and he was placed in the back of the patrol car. A Franklin police officer stayed with Davis’ car since three children were in the back seat, so they could be picked up by a family friend.

Davis consented to a blood draw, and it was drawn at UPMC at 10:53 p.m. on November 21.

On December 8, the result of the BAC (Blood Alcohol Content) was back from the Erie PSP lab. The result was 0.176, the complaint states.

Davis’ preliminary hearing is scheduled for 1:30 p.m. on January 10 with Judge Lowrey presiding.

He faces the following charges:

– DUI: Highest Rate of Alcohol (BAC .16+) 1st Offense, Misdemeanor
– DUI: General Impairment/Incompetent of Driving Safely — 1st Offense, Misdemeanor
– Driving W/O A License, Summary
– Driving While Operator Privilege Suspended Or Revoked, Summary
– Endangering Welfare of Children — Parent/Guardian/Other Commits Offense, Misdemeanor 1

A certified summons was issued to Davis on December 12, 2017.
