Franklin Man Found Not Guilty of Drug Possession

FRANKLIN, Pa. (EYT) — A Franklin man was recently acquitted on drug charges in Venango County Court of Common Pleas.

Court documents indicate 44-year-old James Michael Docherty, of Franklin, was acquitted of the following charges on Thursday, April 18:

– Use/Possession of Drug Paraphernalia, Misdemeanor
– Possession of Controlled Substance, Misdemeanor

The charges stem from a traffic stop on April 7, 2018.

According to a criminal complaint, a vehicle operated by 20-year-old Haley Rene Bean, of Franklin, was stopped after Patrolman Johnson, of the Sugarcreek Borough Police Department, noted some erratic driving patterns.

Bean was placed under arrest for suspicion of DUI following standardized field sobriety testing, the complaint states.

According to the complaint, police discovered drugs and drug paraphernalia in the vehicle.

James Docherty was a passenger in the vehicle.

The following charges against Bean have been filed in the Venango County Court of Common Pleas:

– DUI: Controlled Substance — Schedule 2 or 3 — 1st Offense, Misdemeanor
– Possession Of Marijuana, Misdemeanor
– Use/Possession Of Drug Paraphernalia, Misdemeanor
– Intentional Possession Controlled Substance By Person Not Registered, Misdemeanor

Bean remains free on $1,500.00 unsecured bail.

Docherty was represented by Franklin-based Attorney Eric A. Padin.
