FRANKLIN, Pa. (EYT) – A Franklin man who was combative with officers after a public intoxication incident will stand for a hearing on Wednesday on charges of resisting arrest.

According to court documents, a preliminary hearing against 32-year-old Tyler J. Perry, of Franklin, is scheduled for 1:30 p.m. on Wednesday, April 17, in front of Magisterial District Judge Matthew T. Kirtland.

He faces the following charges:

– Resisting Arrest/Other Law Enforcement, Misdemeanor 2 (three counts)

A certified summons was issued on January 15 and accepted on February 5.

The charges stem from an incident of public drunkenness when Perry became combative with officers, and new charges were filed against him for resisting arrest.

Details of the case:

According to a criminal complaint, around 10:30 a.m. on January 12, Tyler Perry was arrested by Officer Scott, of the Franklin Police Department, for public intoxication.

Perry allegedly admitted to officers to using methamphetamine prior to his arrest. He was transported to the Franklin Police Department and lodged in a cell at 10:52 a.m.

Due to his behavior, a commitment order to the Venango County Jail was granted by Judge Kirtland to ensure Perry’s safety.

Around 3:25 p.m. on January 12, Perry was taken out of the cell at the Franklin Police Department and placed in a secured interview room. A transport belt was then placed around his waist by Officer Barnes. While attempting to place Perry in handcuffs attached to the transport belt, Perry became highly aggressive and combative. He had to be physically restrained in order to be placed in handcuffs. As he proceeded to be non-compliant with verbal orders to stop resisting, Officers Barnes, Young, and Gilchrist were able to restrain him, according to the complaint.

Charges for resisting arrest were filed in Judge Kirtland’s office on January 14.

A non-traffic citation for a summary offense of Public Drunkenness And Similar Misconduct was also filed against him.
