FRANKLIN, Pa. (EYT) — Two Franklin residents who are facing animal cruelty and related charges kept multiple dogs and cats in “horrid conditions,” according to the Franklin Police Department.

According to court documents, criminal charges were filed against 36-year-old Kimberly Dianne Andino-Vazquez, and 60-year-old Edward A. Barrett, both of Franklin.

According to a criminal complaint, on Monday, July 1, Ptlm. Gilchrist, of the Franklin Police Department, was dispatched to a residence on Eagle Street for a complaint of animal cruelty involving a dog later found to belong to Kimberly Vazquez and Edward Barrett.

Ptlm. Gilchrist arrived at the scene and observed several dogs barking and crying from inside the residence. He was then shown recently taken digital photographs by a known witness showing a brown male boxer, identified as “Clyde.”

According to the complaint, the photos showed the dog had extreme weight loss, with its bone structure clearly visible and defined in detail and obvious medical conditions. The dog also displayed no muscle mass on its frame, which is unusual for the breed.

The complaint notes that due to a lack of cooperation from Vazquez and Barrett in allowing Ptlm. Gilchrist to verify the well-being and status of the dog, a search warrant was applied for and granted.

The search warrant was executed on Tuesday, July 2.

According to the complaint, inside the apartment, Ptlm. Gilchrist observed four dogs and four cats, and when he requested licenses for the dogs and rabies vaccination information for all of the animals, Vazquez advised there were none.

Ptlm. Gilchrist then located the dog Clyde and saw that the animal’s condition was worse than the photographs. The dog was immediately seized and transported to the Venango County Humane Society for veterinary care.

According to the complaint, during the investigation conducted and the following 48 hours from the time of notice required by law, neither Vazquez nor Barrett was willing or able to provide veterinary care documentation for Clyde, including care for his specific ongoing condition.

The complaint notes that Barrett stated there was nothing wrong with Clyde.

During the investigation, Ptlm. Gilchrist spoke to a known female who, out of concern for Clyde, provided Clyde with veterinary care at “happy Trails” beginning on May 3, 2019, and provided medication and special dietary food, which directly contradicted Barrett’s statement. The known female also advised that Barrett and Vazquez later refused to continue vet care, directions, and the prescribed diet.

According to the complaint, while in the care of Vazquez and Barrett, Clyde and the other dogs were required to hold their bowels and bladders for long periods of time and not given adequate time to relieve themselves. The cat litter boxes showed large amounts of fecal matter and urine, providing no place for new use.

The complaint notes all of the animals were forced to live in “horrid conditions” within the residence, with Clyde being forced to navigate multiple dangerous obstacles, including multiple staircases that left him at risk for serious bodily injury or death due to his sick and weakened state.

Charges were filed against Vazquez and Barrett on Monday, July 8, in Magisterial District Judge Matthew T. Kirtland’s office.

Andino-Vazquez faces the following charges:

– Vaccination against Rabies Required — Proof of Vaccination, Summary (three counts)

Barrett faces the following charges:

– Neglect of Animals — Tethering, Misdemeanor 3
– Cruelty to Animals
– Application Dog License/Fees, Penalties, Summary

Barrett is scheduled to stand for a preliminary hearing in front of Judge Kirtland at 1:30 p.m. on Wednesday, July 31, and Vazquez is scheduled to stand for a preliminary hearing in front of Judge Kirtland at 8:30 a.m. on Wednesday, August 14.
