Kennerdell Man Accused of Sexual Assault of 15-Year-Old Girl Held for Court

CLINTON TWP., Pa. (EYT) – A Kennerdell man who allegedly gave a 15-year-old girl alcohol and then sexually assaulted her was held for court on Wednesday.

Court documents indicate the following criminal charges against 32-year-old Luke A. Waagner, of Kennerdell, were held for court on Wednesday, May 15:

– Unlawful Contact With Minor – Sexual Offenses, Felony 3
– Corruption of Minors, Misdemeanor 1
– Indecent Assault Person Less 16 Years Age, Misdemeanor 2
– Sell/Furnish Liquor Etc Minor, Misdemeanor 3

The charges have been transferred to the Venango County Court of Common Pleas.

Waagner remains free on $10,000.00 unsecured bail.

According to a criminal complaint, on Sunday, March 17, an investigation was initiated by Corporal Birckbichler, of Mercer-based State Police, following a report of a sexual assault that allegedly occurred in Venango County at the home of Luke A. Waagner. The case was later forwarded to the Franklin-based State Police.

Around 11:07 a.m. on March 26, the known 15-year-old victim was forensically interviewed at the Mercer County Child Advocacy Center.

According to the complaint, the victim reported that while visiting at a Kennerdell residence, she was sitting in a chair in the living room talking to Luke Waagner when he stated: “I don’t have enough alcohol to deal with your (expletive),” and noted she believed Waagner was an alcoholic “because he drinks all the time.” The victim then went with Waagner, who allegedly purchased two six packs of bottled alcohol before driving back to the residence.

The victim told the interviewer, “me being a stupid teenager I drank two” and indicated that Waagner’s “thing is he won’t physically hand alcohol to a minor, but it is just there if I want it and go and grab it,” the complaint states.

According to the complaint, the victim noted that Waagner placed one bottle of alcohol close to her to grab, so she didn’t have to get up from her chair.

The complaint states the victim reported that she drank two full Twisted Teas and approximately 3/4 of a third bottle with Waagner, while Waagner drank the remainder of the alcohol, indicating he drank nine drinks. She also noted she cannot “hold her alcohol very well because she is a teenager.”

According to the complaint, the victim said she was sleeping in a recliner and woke up at some point on the night on her side, almost on her stomach, with the footrest of the recliner up, and the back of her shirt pulled up and her bra unfastened. She reported Waagner was sitting beside her rubbing her back and side and eventually her chest and noted it made her very uncomfortable. She then pretended to be asleep until she did fall back asleep. The victim related when she woke up, she noticed her bra may have been undone because it was fastened differently than she usually fastens it, though her shirt was back down.

The victim noted that while they were drinking, they were just talking to each other, but then spoke about how her shirt was pushed up in the font, and Waagner was rubbing her side by her hip and then began to rub her chest under her clothing, including her bra, according to the complaint. She also said Waagner was “groping” her chest, and said when she awoke at one point, the recliner was rocking back and forth, nothing she thought Waagner was “touching himself” while he was touching her.

The complaint notes that when asked if Waagner had ever done anything like this to her before, she didn’t respond to the specific question, but noted that she remembered Waagner telling her that he “liked” someone in the family a long time ago. She reported she told her mother about it, but she indicated “it wasn’t a big deal.” She also related that Waagner called her “gorgeous” and told her she is “actually attractive.”

Based on the investigation, Waagner was arraigned in front of Magisterial District Judge Patrick E. Lowrey at 2:30 p.m. on Wednesday, May 8.
