Local Man Accused of Attempting to Buy Pistol Illegally in Cranberry Township

CRANBERRY TWP., Pa. (EYT) – A Titusville man is facing criminal charges for allegedly providing false statements to a Cranberry Township sports store in an attempt to purchase a pistol.

According to a criminal complaint, correspondence received from the Firearms Division of PSP Bureau of Records and Identification revealed that on October 1, 2016, 55-year-old Kevin Donald Johnson, of Titusville, attempted to acquire a Ruger LCP 380 caliber pistol from a sports store in Cranberry Township, Venango County.

The complaint states that correspondence indicated that the questions Kevin Johnson is believed to have answered falsely by saying “No” are as follows:

– ATF Form 4473 (Firearms Transaction Record Part 1 – Over-the-Counter, Section A) Question 11c – “Have you ever been convicted in any court for a felony, or any other crime, for which the judge could have imprisoned you for more than one year, even if you received a short sentence including probation?”

– Application/Record of Sale Form SP4-113, Question 31: “Have you ever been convicted of a criminal enumerated in section 6105(b), or do any of the conditions under 6105(c) apply to you? (Read information on back prior to answering.)”

According to the complaint, correspondence received from the Firearms Division of the PSP Bureau of Records and Identification revealed that Johnson was arrested by PSP Corry on March 6, 1981, for an F1 Burglary. Johnson pled guilty on May 14, 1981, and was sentenced to nine months of county probation, April 14 1994.

Johnson was arraigned at 11:30 a.m. on March 9, 2017, in front of Magisterial District Judge Patrick E. Lowrey on the following charges:

– Materially False Written Statement – Purchase, Delivery, Transfer of Firearm, Felony 3
– Unsworn Falsification to Authorities, Misdemeanor 2
– Statement Under Penalty, Misdemeanor 3

Johnson is free on $5,000.00 unsecured bail.

A preliminary hearing is scheduled for 8:30 a.m. on April 5, 2017, with Judge Lowrey presiding.
