Mailman Accused of Sexually Assaulting Woman While Delivering Package

FRANKLIN, Pa. (EYT) – A mailman for the U.S. Postal Service is facing sexual assault charges after a joint investigation by the Franklin City Police and the USPS.

According to court documents, on Thursday, December 28, the Franklin Police Department filed the following criminal charges against 47-year-old Terry N. Duck, of Seneca:

– Burglary – Overnight Accommodations; Person Present, Bodily Injury Crime, Felony 1
– Criminal Trespass-Enter Structure, Felony 3
– Indecent Assault Forcible Compulsion, Misdemeanor 1 (two counts)
– Indecent Assault-W/O Consent Of Other, Misdemeanor 2

The charges stem from incidents that occurred at a Taylor Street residence between November 10 and 28.

According to a criminal complaint, Franklin City Police Detective Kevin Saragian received a call from U.S. Postal Inspector Erik Bohin about a sexual assault complaint they had received regarding Terry Duck.

On November 30, the Franklin Post Office reported to the Postal Inspector’s Office in Pittsburgh that a female victim had reported Duck for sexually assaulting her. When Inspector Bohin came to Franklin on December 1, he interviewed Duck, the victim and two witnesses and obtained written statements, the complaint states.

Inspector Bohin said that Duck admitted to kissing the victim on her neck several times, but denied any inappropriate touching of the victim, the complaint continues.

On December 6, the U.S. Postal Inspector Service performed a polygraph test on Duck, which he failed. A follow-up interview with Inspector Bohin revealed that Duck admitted to touching the victim’s buttocks, but he denied touching the woman in her vaginal area, according to the complaint.

On December 7, Detective Saragian interviewed the female victim, and she said Duck began complimenting her and telling her she looked nice. He also made comments in regards to the Victoria’s Secret packages she received in the mail. She said there were two incidents where he touched her inappropriately, the complaint states.

The victim said the first incident occurred on November 10 when she was waiting for an expensive package to be delivered. She saw the mail truck parked at the mailbox station for the apartment complex, and she stopped to see if Duck had her package. He said he did, scanned it, and handed it to her. When she reached out with both hands to accept the package, she said Duck ran his right hand down and then back up her left side proceeding to cup her left breast with his right hand. She asked Duck if he was married and he said he was, the complaint indicates.

The victim told Detective Saragian the second incident happened on November 28 when he delivered a package to her door. He handed it to her and said she looked nice today while running his hand down her left side and squeezing her buttocks. She said she stepped backward and told Duck he needed to go back to work, the complaint states.

The victim said after Duck had left, she went outside and was smoking a cigarette with two other witnesses when Duck returned in the mail truck and said he had forgotten to scan the package. She went inside to retrieve the food item from her refrigerator and when she turned around, Duck was standing directly behind her in the kitchen area. She handed the item to Duck, and he scanned it. She then tried to walk past him, and he grabbed her by the arm and asked her what she was doing, according to the complaint.

The victim stated that she replied that she was going outside, to which he replied ‘No, not yet’ and stepped toward her. The victim stated that she put her hands up and told him that he should probably be going back to work. She said that he then reached his arms out and pinned her arms down and that he then ran one of his hands across her chest, and then ran his hand through her hair, the complaint states.

The victim indicated that Duck then began kissing her on her cheek, jawline, and neck areas and that she told him that he needed to leave. She also said that Duck then proceeded to run his hand down the right side of her body, running his hand down her thigh and back up on the inside of her thigh and crotch area, where his middle finger grazed the outside of her underwear. She stated that she then put her hand on his chest again stating that he needed to leave. At this point, he then stormed out shoving the front door open and sprinted to the mail truck and left, according to the complaint.

The victim stated that she had told the mailman ’no’ and that he needed to leave numerous times to which he refused, the complaint indicates.

Detective Seragian then spoke with the two witnesses, one of whom stated that she viewed the mailman enter the victim’s residence, and the other witness who heard the victim state to the mailman to hold on that she would be right back, prior to the defendant entering the residence, the complaint continues.

A preliminary hearing has yet to be scheduled for Duck.
