Man Faces Charges for Failing to Pay Contractor for Services in Scrubgrass Township

SCRUBGRASS TWP., Pa. (EYT) — A 40-year-old man is facing a felony charge after allegedly failing to pay a subcontractor for services.

Court documents indicate the Franklin-based State Police filed criminal charges against 40-year-old David Lawrence Birckbichler, of Butler.

According to a criminal complaint, around October 16, 2015, a local plumbing and heating business provided an estimate of $11,515.00 to David Birckbichler to purchase and install a new heating, ventilation, and air conditioning system (HVAC) at a residence in Scrubgrass Township. Birckbichler was serving as a general contractor for the homeowner of the residence.

An agreement was made and the local plumbing and heating company was subcontracted to complete the HVAC tasks at the residence. Per the agreement, the company requested $5,000.00 upon acceptance and the remaining $6,515.00 upon completion of the project.

According to the complaint, the homeowner provided two separate checks to Birckbichler for a total amount of $11,507.50 designated for the HVAC work to be completed by the plumbing and heating company, and Birckbichler provided the company with $5,000.00.

The HVAC project was completed by January 4, 2016, but Birckbichler failed to pay the local plumbing and heating company any of the $6,515.00 remaining balance, according to the complaint.

Based on the investigation, Birckbichler was arraigned at 3:00 p.m. on September 11 in Magisterial District Judge Patrick E. Lowrey’s office on a third-degree felony count of theft by failure to make required disposition of funds.

Birckbichler is free on $7,500.00 unsecured bail.

A preliminary hearing is scheduled for 1:30 p.m. on Wednesday, October 17, in Venango County Central Court.
