Man Faces Multiple Charges After Allegedly DUI, Fleeing Police in Tionesta Area

FOREST CO., Pa. (EYT) — A 44-year-old man is facing multiple charges after he was allegedly DUI and fled from police on German Hill, in Green Township, Forest County.

According to online court documents, the Forest County Sheriff’s Office filed criminal charges against 44-year-old William Scott Butler, of New Castle.

According to a criminal complaint, around 11:57 p.m. on November 26, 2016, Warren County 911 requested the Forest County Sheriff’s Department to assist PSP Marienville for an obviously intoxicated male waiving a firearm at Flying W Ranch in Tionesta.

The complaint states that when Deputy Wilson, of the Forest County Sheriff’s Office, arrived on the scene, he was advised that the individual had left the Flying W Ranch in a gray (or silver) coupe and was possibly headed to his camp on Sunnyside Drive located off German Hill in Tionesta. Deputy Wilson responded to the camp location and positioned his marked cruiser on German Hill in a driveway across from Sunnyside. Shortly afterwards, a car was approaching the area, and it was swerving from one side of the road to the other. As the car came approximately 15 feet from the cruiser, the driver of the car turned the lights off and attempted to drive in reverse down the road.

Deputy Wilson activated the overhead lights and siren, and the car traveled in an erratic way in reverse, and on multiple occasions, it drove into the ditch. At some point, Deputy Wilson positioned his patrol car between the fleeing vehicle and the oncoming traffic, and the car came within approximately five feet from striking the patrol vehicle and ended up with the right rear tire in the ditch, the complaint continues.

Deputy Wilson called Warren 911 at 12:20 a.m. to verify the plate on the car and asked for immediate back up. Due to the original 911 dispatch regarding an intoxicated male with a firearm, Deputy Wilson conducted a felony stop. The male driver was ordered out of the vehicle and to the ground.

The complaint states that Deputy Wilson did an initial pat down of the suspect. He located two pocket knives. A flask was located in the right breast pocket, and it was open and leaking. Deputy Wilson asked Butler if he was drinking and he responded, “I think that’s obvious.”

A firearm was located wedged in between the center console and the driver’s seat as well as multiple loaded magazines and a shoulder holster on the seat, the complaint continues.

At this time, Deputy Wilson was able to verify the identity of the driver as William Scott Butler who was being sought by PSP Marienville for the incident at Flying W Ranch. Butler was asked to submit to a series of tests to assess his balance. Based on the multiple clues from a battery of three tests, his slurred speech, and strong odor of an intoxicating beverage, Butler was placed under arrest for the suspicion of driving under the influence, according to the complaint.

Butler was transported to the Forest County Sheriff’s Office for further testing, and following a series of unsuccessful tests due to Butler uncooperative behavior, he was advised that a submission of refusal would be documented.

At this time, Butler became irate and said “I want a (expletive) Statey in there with me or things are going to get real bad around here,” the complaint states.

When Deputy Wilson asked Butler if that was a threat, he stated “(expletive) things are about to get real bad real quick.” He allegedly stated that he was about to lose his temper, and they didn’t want to see that, the complaint indicates.

According to the complaint, Butler calmed down, but then became irate again during the breath test. He stood up and attempted to push past Deputy Wilson and a significant amount of physical force was needed to get Butler back into his chair. Butler then said he was “not going to give anymore to this (expletive) punk.”

Butler was given copies of all of his tests per his request, and he was released to PSP Marienville for transport to his camp, the complaint continues.

The Forest County Sheriff’s Office filed the following charges against Butler in Magisterial Judge Daniel L. Miller’s office:

A preliminary hearing is scheduled for 11:30 a.m. on February 28 in front of Judge Miller.

No information was available regarding the firearms incident.
