Area Man Accused of Threatening to Kill District Judge

FINDLEY TWP., Pa. (EYT) — A Greenville man is facing criminal charges for allegedly threatening to kill a Magisterial District Judge.

Court documents indicate the Mercer County Detectives on April 17 filed criminal charges against 60-year-old Duane Allan Gruber.

According to a criminal complaint, Chief County Detective Grolemund, of the Mercer County District Attorney’s Office, received a report from a corrections officer at the Mercer County Prison on Thursday, April 16, detailing threats the officer witnessed being made by Duane Allan Gruber against Magisterial District Judge Brian Arthur.

Court documents indicate Gruber was arraigned in front of Judge Arthur on April 16 on two third-degree misdemeanor counts of defiant trespass, two third-degree misdemeanor counts of disorderly conduct, and two third-degree misdemeanor counts of harassment related to an incident that occurred on April 14.

According to the complaint, Gruber made threats prior to and during the video arraignment.

Prior to the arraignment, Gruber reportedly stated, “No way he (Judge Arthur) survives,” and said “We have ways of keeping corrupt judges out. It’s called the second amendment.”

During the video arraignment, Gruber told Judge Arthur he would see him “hung in Kennard,” according to the complaint.

Judge Arthur was also contacted and confirmed the report and the threat he received during the video arraignment, the complaint indicates.

Gruber was arraigned in front of Magisterial District Judge Daniel W. Davis at 2:03 p.m. on Friday, April 17, on one first-degree misdemeanor count of terroristic threats with intent to terrorize another.

His bail was set at $25,000.00 monetary bail for this case.

A preliminary hearing is scheduled for 10:00 a.m. on Monday, April 27, with Judge Davis presiding.

A preliminary hearing on the prior case is scheduled for 1:00 p.m. on Tuesday, April 28, with Judge Arthur presiding.
