Man Waives Preliminary Hearing on Drug-Related Incident in Franklin

FRANKLIN, Pa. (EYT) — A 26-year-old man who is facing drug-related charges stemming from an incident that occurred in Franklin has waived his preliminary hearing.

According to online court documents, drug charges against 26-year-old Daquan L. McNair,, of Warren, Ohio, have been transferred to Venango County Court of Common Pleas.

Details of the Drug-Related Incident

According to a criminal complaint, Franklin Police Officer Jonathan Kutterna was on patrol on December 21, 2016, when state probation and parole agents asked for his assistance at 10 Arbor Circle in Franklin.

The complaint states that Officer Kutterna spoke with Daquan McNair as an agent attempted to handcuff him, but McNair broke away and ran from the residence into the woods. As Officer Kutterna chased McNair, he observed McNair throw something onto the ground. McNair refused to stop running until Officer Kutterna threatened to taze him.

McNair then complied and was taken into custody by Kutterna. After handcuffing him, Kutterna found a bag of marijuana in McNair’s possession. After placing McNair in the patrol car, Kutterna returned to the area where the foot chase began, and two bags containing suspected Heroin and Cocaine were discovered, according to the complaint.

McNair was arraigned at 3:30 a.m. on December 22 in front of Magisterial District Judge Patrick E. Lowrey and placed in the Venango County Jail on $50,000.00 monetary bail.

On January 4, McNair waived his preliminary hearing and will face a possible trial on the following charges:

– Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony 1

– Use/Possession Of Drug Paraph, Misdemeanor

– Possession of Marijuana, Misdemeanor

A second-degree misdemeanor charge of Resist Arrest/Other Law Enforcement was withdrawn.

McNair remains lodged in the Venango County Jail.

The case is working its way through the court system.
