New Details Emerge in Case Against Local Couple Arrested on Forgery, Drug Charges

FRANKLIN, Pa. (EYT) — Two Franklin individuals are in custody following an investigation of a reported vehicle theft.

According to court documents, the Franklin Police Department filed criminal charges against 23-year-old Kathleen Nicole Gagliotti and 31-year-old, Cole Nathaniel Borgia, both of Franklin.

According to a criminal complaint, on December 10, Kathleen Gagliotti allegedly entered another person’s residence in Franklin and conspired via a cell phone with Cole Borgia to steal a blank check.

The complaint states that Gagliotti and Borgia then allegedly prepared the check in the amount of $70.00, cashed it, and used the money in an attempt to purchase Heroin.

Then, on December 11, Officer Barnhart, of the Franklin Police Department, was dispatched to Liberty Street, and Gagliotti reported that an unknown person stole her vehicle, the complaint continues.

During the course of the investigation, it was learned that Gagliotti’s vehicle was involved in a collision.

In a followup interview, Gagliotti allegedly admitted that she lied to officers concerning the theft of her vehicle, according to the complaint.

She allegedly stated that she facilitated the purchase of Heroin, and her drug dealer took her vehicle to Youngstown, Ohio, with her permission for the purpose of purchasing Heroin. In return, Gagliotti was to receive one gram of Heroin, the complaint states.

A review of the text messages to the drug dealer revealed that Gagliotti allegedly demanded money or drugs, or else in retaliation, she would contact the police and report her vehicle as stolen. When Gagliotti received neither money nor drugs, she reported to law enforcement that her vehicle was stolen, according to the complaint.

Text messages between Borgia and Gagliotti allegedly implicated Borgia in the crimes, the complaint continues.

Case against Gagliotti

Gagliotti was arraigned at 2:54 p.m. on December 16 in front of Magisterial District Judge Matthew T. Kirtland.

She faces the following charges:

– Identity Theft, Felony 3
– Conspiracy – Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver
– Criminal Use Of Communication Facility, Felony 3
– Forgery – Unauthorized Act In Writing, Felony 3
– Theft Extort-Threat To Accuse Another, Misdemeanor 1
– False Report – Falsely Incriminate Another, Misdemeanor 2
– Theft By Unlawful Taking-Movable Property, Misdemeanor 2
– Unsworn Falsification to Authorities, Misdemeanor 2
– False Reports – Reported Offense Did Not Occur, Misdemeanor 3

Unable to post $15,000.00 monetary bail, she was lodged in the Venango County Jail.

A preliminary hearing is scheduled 1:30 p.m. on December 21 in Venango County Central Court with Judge Kirkland presiding.

Case against Borgia

Borgia was arraigned at 5:00 p.m. on December 16 on the following charges:

– Conspiracy – Identity Theft, Felony 3
– Conspiracy – Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver
– Criminal Use Of Communication Facility, Felony 3
– Conspiracy – Forgery – Unauthorized Act In Writing, Felony 3
– Conspiracy – Theft By Unlawful – Taking-Movable Property, Misdemeanor 2

A preliminary hearing is scheduled for 1:30 p.m. on December 21 in Venango County Central Court.

Bail was denied, and Borgia was lodged in the Venango County Jail.

The reason for the bail action is because Borgia was currently out on bail and has a history of noncompliance of bail conditions.
