  • Simple Assault, Misdemeanor 2
  • False Identification To Law Enforcement Officer, Misdemeanor 3

According to a criminal complaint, officers of the Oil City Police Department were dispatched to a location on Colbert Avenue around 9:17 p.m. on Friday, December 7, for a report of a domestic assault.

Lieutenant Love, of the Oil City Police Department, responded and was advised that the suspect fled the scene and was heading to the south side via the Wye Bridge.

The victim told Lieutenant Love that she picked up Marcus Stewart from a friend’s house.

The victim stated that Stewart was very intoxicated.

She reported that Stewart began punching the dash of her vehicle and then ripped off the rearview mirror. The victim said Stewart then struck her in the face, causing her to be unable to see and forcing her to pull the vehicle over. Stewart went to strike her a second time, but a known male who was in the back seat had already exited the vehicle and began to pull Stewart out.

The victim said the known male put Stewart in a “headlock” to get him under control. Stewart then fled the scene.

The complaint notes that Stewart was located by Officers Anderson and Drake on the south side of the Wye Bridge, where he was placed under arrest.

According to the complaint, when Stewart was asked his name, he gave only the name “Dan,” and when asked a second time, he said, “None of your [expletive] business” and began to flail around, trying to pull away from the officers. He was then placed inside a police vehicle.

The complaint also notes that later, when Stewart was placed in a cell and was being searched, he became very upset after learning that his probation officer would be notified of the incident.

According to the complaint, after being told several times to remove his boots, Stewart said, “You want this [expletive] boot” and then pulled off his boot and threw it at Lieutenant Love, striking him in the right leg.

Stewart was arraigned at 9:20 a.m. on Saturday, December 8, in Magisterial District Judge Matthew T. Kirtland.

Unable to post $5,000.00 monetary bail, he remains lodged in the Venango County Jail.

A preliminary hearing is scheduled for 1:30 p.m. on Wednesday, December 19, with Judge Kirtland presiding.
