CORNPLANTER TWP., Pa. (EYT) — An Oil City man is facing charges stemming from an incident in which he allegedly struck his neighbor’s door with a sledgehammer.

Court documents indicate the Franklin-based State Police filed criminal charges against 36-year-old Jesse Edward Wagner, of Oil City, on July 23:

  • Criminal Mischief-Tamper With Property, Misdemeanor 2
  • Possession of Controlled Substance, Misdemeanor
  • Use/Possession Of Drug Paraphernalia, Misdemeanor
  • Disorderly Conduct-Unreasonable Noise, Summary
  • Public Drunkenness And Similar Misconduct, Summary

Details of the case:

According to a criminal complaint, around 4:52 a.m. on Wednesday, July 4, Trooper Cirell, of PSP Franklin, was dispatched to a residence on Petroleum Center Road in Cornplanter Township.

The complaint states that the female caller stated that Jesse Wagner was beating her front door with a sledgehammer, which caused considerable damage to the door. She also said Wagner was asking for help and demanded to be let inside her home because he thought someone had been chasing him through the wooded area adjacent to the residence.

Upon his arrival, Trooper Cirell took Wagner into custody.

According to the complaint, Wagner immediately started to tell Trooper Cirell that someone had struck him in the face, but said he did not know who did it.

Trooper Cireloccurred Wagner where the incident occurred and Wagner said that the person struck him back at his residence, also located on Petroleum Center Road.

Trooper Cirell transported Wagner back to his residence and asked for his consent to go into the residence and search for the person who struck him. Wagner agreed to allow a search if he was permitted to go along.

According to the complaint, as Trooper Cirell and Wagner walked through the residence, Trooper Cirrell observed syringes in the bathroom, living room, and bedroom of the residence, and a white cap with a powder substance inside it as well as a glass pipe sitting inside a dresser in the bedroom.

Wagner said the dresser belonged to him, according to the complaint.

Trooper Cirell returned Wagner to his patrol car once they discovered there was no one other than Wagner’s girlfriend in the residence. Trooper Cirell read Wagner his Miranda Rights and asked him again what happened.

According to the complaint, Wagner said that he and his girlfriend were using methamphetamine that night, stated “we both had two syringes, mine was out of a cap, and she did hers out of a spoon.”

Wagner also continued to assert that someone struck his face.

Trooper Cirell then spoke to Wagner’s girlfriend. She explained that no one hit Wagner and said that his lip was swollen because he habitually bites it.

Based on the investigation, charges were filed against Wagner in Magisterial District Judge Andrew F. Fish’s office on Monday, July 23.

A preliminary hearing is scheduled for 1:30 p.m. on Wednesday, September 5.
