OIL CITY, Pa. (EYT) — An Oil City man is facing resisting arrest charges and related offenses after a scuffle with police early Monday morning.

Court documents indicate the Oil City Police Department filed criminal charges against 25-year-old Cole Wesley Durr, of Oil City.

According to a criminal complaint, around 1:13 a.m. on Monday, May 7, Oil City Police officers were dispatched to a residence on Lincoln Street for a male who was intoxicated and attempting to fight with another known male.

Upon arrival, the officers made contact with a male identified as Cole Durr.

Patrolman Drake noted that upon contact with Durr, the officers were able to smell the odor of alcoholic beverages coming from his breath. Durr was slurring his words and had glassy, bloodshot eyes, the complaint states.

The officers instructed Durr to step outside several times so they could speak to the known male who was upstairs in the residence, but Durr allegedly refused and would not allow the officers past him, the complaint indicates.

After Durr’s repeated refusal to comply with the officer’s requests, they attempted to take him into custody, but he began to resist and physically fight the officers, according to the complaint.

Patrolman Drake then deployed his Taser. Prior to the officers being able to handcuff Durr, he managed to break the wires off the Taser probes and remove the probes while continuing to resist arrest, ignoring the officers’ instructions to stop resisting and place his hands behind his back, the complaint states.

Officers were finally able to place Durr under arrest after the struggle, and he was transported to the Oil City Police Department.

Durr was arraigned at 9:30 a.m. on Monday, May 7, in Magisterial District Judge Andrew F. Fish’s office on the following charges:

– Resist Arrest/Other Law Enforcement, Misdemeanor 2
– Disorderly Conduct Engage In Fighting, Misdemeanor 3

He is currently free on $10,000.00 unsecured bail.

A preliminary hearing is scheduled for 1:30 a.m. on Wednesday, May 16, with Judge Fish presiding.
