Oil City Man Facing Felony Assault Charges After Fighting Police

OIL CITY, Pa. (EYT) — An Oil City man is facing felony assault and related charges after he allegedly struggled with police after being reported for drunk driving.

Court documents indicate the Oil City Police Department filed the following charges against 57-year-old Kevin Robert Smrekar, of Oil City:

– Aggravated Assault, Felony 2 (two counts)
– Resist Arrest/Other Law Enforcement, Misdemeanor 2
– Simple Assault, Misdemeanor 2
– DUI: General Impairment/Incapable of Driving Safely — 1st Offense, Misdemeanor

The charges stem from an incident that occurred on Friday, July 5.

According to a criminal complaint, around 2:40 p.m. on Friday, July 5, Oil City Police were dispatched to Butternut Alley for a report of a possible drunk driver. Police responded to the scene and learned, through dispatch, the reported vehicle belonged to Kevin Smrekar of Alcorn Avenue, Oil City.

Police proceeded to Smrekar’s residence and made contact.

The complaint states that Smrekar showed general signs of impairment before the officers spoke with him, and after a brief investigation, officers attempted to place Smrekar into custody for DUI.

According to the complaint, Smrekar fought with the officers and ultimately attempted to punch Patrolman Culp in the face and was able to kick Patrolman Rosenberger in the knee. Smrekar was then placed in custody and transported to the Oil City Police Station.

The complaint notes that at 10:02 p.m. Smrekar was transported to the Venango County Jail where he was given a portable breath test which showed positive results for alcohol at that time.

Smrekar was arraigned in front of Magisterial District Judge Matthew T. Kirtland at 10:45 p.m. on Monday, July 8.

Unable to post $50,000.00 monetary bail, he was lodged in the Venango County Jail.

A preliminary hearing is scheduled for 8:30 a.m. on Wednesday, July 17, in Venango County Central Court with Judge Kirtland presiding.
