Oil City Man Receives Three Years Probation for Drug Charge

RINKER, GFRANKLIN, Pa. (EYT) – An Oil City man who pleaded guilty to felony drug charges was sentenced to probation.

According to court documents, 21-year-old Gaven James Rinker, of Oil City, pleaded guilty on April 24 to one count of the manufacture, delivery, or possession with the intent to manufacture or deliver in a marijuana-related case from October 2016.

Court documents indicate that Rinker was sentenced to 36 months probation.

Additionally, he must undergo an assessment by the Venango County Substance Abuse Program and must comply with any recommendation by SAP.

Details of the case

According to a previous article on explorevenango.com, around 5:47 p.m., October 5, 2016, Franklin State Police observed a red Chevrolet Aveo traveling north on Colbert Avenue in Oil City.

There were several occupants in the vehicle; “all were staring straight ahead” as the vehicle passed the stationery marked patrol unit. When police ran a registration on the vehicle, the check results returned as “suspended due to insurance cancellation.”

The vehicle turned right onto Mylan Street and a traffic stop was initiated.

As police approached the vehicle, “all four occupants were still staring straight ahead and not moving.” It was noted that the passenger in the back seat driver’s side “was observed breathing heavily and appeared extremely nervous,” according to the complaint.

When police requested driver’s license, registration, and proof of insurance, the driver related that he had lost his driver’s license.

A “moderate odor of cologne or perfume and a slight odor of marijuana was noticed,” the complaint said.

The complaint indicated that the back seat passenger’s side occupant – Gaven James Rinker – stated that the vehicle was his.

It was discovered that the driver of the vehicle had a suspended license. The vehicle’s registration was also suspended. At this time PSP Franklin requested the assistance of the Oil City Police, the complaint states.

Upon the arrival of the Oil City Police – a short time later, “the smell of marijuana in the vehicle was now stronger, and the scent of cologne/perfume had faded,” the complaint continued.

All occupants of the vehicle were requested to exit the vehicle, and short interviews were conducted.

During Rinker’s interview, “he voluntarily emptied his pockets, and $886 in cash was noted. It was later discovered that Rinker was not employed,” according to the complaint.

One of the occupants of the vehicle related there was marijuana inside the vehicle, the complaint states.

According to the complaint, a probable cause search of the vehicle was conducted, and a black book bag located in the middle back seat contained the following items:

– Clear zip lock bag containing three separate clear bags with marijuana

– Clear zip lock bag containing four separate clear bags with marijuana

– Clear glass jar containing suspected marijuana

– Black digital scale

– Several clear small zip lock bags and cellophane

– Glass smoking apparatus

Also located inside the vehicle was a folded bank card.

Rinker stated that he was the owner of the black book bag and contents. He was placed under arrest, according to the complaint.
