Oil City Teen Arrested After Illegal Gun Fell Out of Shorts During Traffic Stop

SUGARCREEK BOROUGH, Pa. (EYT) – An 18-year-old Oil City teen is facing felony charges after being caught with a concealed gun with an altered serial number and marijuana during a traffic stop in Sugarcreek Borough.

Court documents indicate the Sugarcreek Borough Police Department filed criminal charges against 18-year-old Dylan James Wagner, of Oil City.

According to a criminal complaint, on Wednesday, June 12, Sr. Ptlm. Highfield, of the Sugarcreek Borough Police Department, initiated a traffic stop on a vehicle at Allegheny Boulevard and Third Street for a speeding violation.

According to the complaint, while approaching the vehicle, Sr. Ptlm. Highfield noted the odor of marijuana coming from the vehicle.

The complaint notes that a passenger in the vehicle was immediately arrested for an outstanding warrant through the Venango County Sheriff’s Department.

Dylan James Wagner, who was also a passenger in the front of the vehicle, was then asked to exit the vehicle so officers could conduct a search incident to the arrest of the other passenger.

As Wagner spread his legs, a revolver fell out of his shorts. Sr. Ptlm. Highfield, being aware Wagner was 18-years-old and not eligible for a concealed carry permit, then took him into custody, the complaint states.

The complaint notes the revolver was a H&R Model 904 .22 revolver, and closer inspection discovered that the serial number had been scratched off of the gun, which had two live rounds in it.

Wagner was then read his rights and asked about anything else in the vehicle.

According to the complaint, he told police there was about an ounce of marijuana in the bag that had been at his feet. Sr. Ptlm. Highfield then discovered a container inside the bag with approximately 28 grams of marijuana, as well as a digital scale, ten baggies, a grinder, and other containers.

The complaint notes Wagner was also found to have $482.00 in cash on him.

Wagner was arraigned in front of Magisterial District Judge Andrew F. Fish at 9:56 p.m. on Wednesday, June 12, on the following charges:

– Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony
– Posses Firearm With Manufacturer Number Altered, Etc, Felony 2
– Firearms Not To Be Carried Without License, Felony 3
– Use/Possession Of Drug Paraphernalia, Misdemeanor

Wagner was lodged in the Venango County Jail with bail denied. The court documents list the reason for the denial as “Defendant has a weapon which could have harmed officers or himself. Also had drugs and drug paraphernalia.”

A preliminary hearing is scheduled for 1:30 p.m. on Wednesday, June 19, in Venango County Central Court with Judge Fish presiding.
