Polk Homeowner Fires Gun, Scares Off Home Invader

FRENCHCREEK TWP., Pa. (EYT) — Charges have been filed in connection with a March 26 home invasion at a Georgetown Road residence.

On Sunday, Franklin-based State Police Tpr. Armagost filed the following charges against 26-year-old Joseph M. Fisher, of Polk, at Magisterial District Judge Matthew T. Kirtland’s office:

  • Burglary — Overnight Accommodations; Person Present, Bodily Injury Crime, Grade Unknown
  • Criminal Trespass-Break Into Structure, Felony 2
  • Simple Assault, Misdemeanor 2
  • Recklessly Endangering Another Person, Misdemeanor 2
  • Criminal Mischief — Damage Property, Misdemeanor 2

State Police Respond to Burglary Call

On March 26 around 2:32 a.m., Tpr. Armagost responded to the scene of a burglary at 4139 Georgetown Road.

According to a criminal complaint filed Sunday, a 21-year-old male resident of the home told Tpr. Armagost that he had a backyard gathering late Saturday evening.

He told Tpr. Aramagost that a female friend of his girlfriend attended the gathering. The 21-year-old man asked the female to leave after an argument ensued.

Fisher Allegedly Arrives at Residence, Fight Ensues

A short time later, the woman’s husband — Joseph Fisher — arrived at the residence and was “highly intoxicated, very angry, and wanted to fight,” according to the criminal complaint.

Fisher allegedly grabbed the male victim by the throat and then “took a swing” at him. The victim stated that he then “beat the sh*t out of (Fisher).”

The fight was broken up, and the two men shook hands, according to the victim.

The victim stated that he did not call the police because he thought “they settled it.”

Fisher Allegedly Returns to Residence

Approximately 20 minutes later, Fisher and two other men arrived at the residence in a Ford F-250 flatbed truck, the complaint states.

At this point, the victim and his girlfriend locked themselves in a bedroom, and the victim grabbed a gun. He then called 911.

According to the criminal complaint, the victim stated that he heard kicking and pounding on the rear and front doors.

The victim also told Tpr. Armagost that he heard Fisher trying to lure him outside to fight.

He then heard someone smashing a window. At that point, Fisher allegedly walked into the house and began “yelling for him to come out and fight,” according to the complaint.

Fisher then allegedly “pounded on the bedroom door,” before exiting the residence.

A short time later, Fisher allegedly “smashed out” the bedroom window and yelled, “there you are,” the complaint continues.

The victim then pointed his revolver out of the bedroom window, away from Fisher, and fired one shot into the ground.

According to the victim, Fisher responded by saying “You gonna bring a gun into this, well this ain’t over,” the complaint states.

Fisher and the other men returned to their vehicle and headed towards Franklin, according to the criminal complaint.

The victim told Tpr. Armagost that he did not know who the other men were.

Physical Evidence Found at the Scene

Tpr. Armagost discovered a broken bedroom window and a broken kitchen window along with a damaged living room window.

He also found blood on the rear door, the bedroom window frame, the wall under the living room window, and the living room carpet.

Dirt marks from a shoe were found on the rear door, according to the criminal complaint.

Fisher Taken Into Custody

Fisher was taken into custody and placed in the Venango County Jail after failing to post $25,000.00 cash bail.

He faces a preliminary hearing on April 5 at 8:30 a.m. before Judge Kirtland.
