Traffic Stop Leads to Drug Charges Against Franklin Man

CLARION, Pa. (EYT) — A Franklin man is facing charges of drug possession after a traffic stop in Clarion.

According to court documents, the Clarion Borough Police Department filed criminal charges against 18-year-old Juan Felipe Hugus, of Franklin, on January 4.

According to the criminal complaint, Officer Maxwell, he was on patrol October 20, 2017, when he saw a black Fiat 500 with a New Jersey license plate traveling east on Main Street at a high rate of speed. Officer Maxwell then pulled the car over, and when he asked the driver for his license, the known man presented a New Jersey driver’s license.

Officer Maxwell smelled burned marijuana coming from inside the car and asked the known man who had the drug. The man denied there was marijuana in the car, and Officer Maxwell called for backup because there were several other passengers in the car, according to the complaint.

Officers Scheckler and Foust arrived and Officer Maxwell had the driver exit the car as well as the backseat passengers, which included Juan Felipe Hugus and Jose Miguel Hugus, both of Franklin, Bethany Marie Lindsay, of Oil City, and two other known males, the complaint states.

The driver of the vehicle was given a standard field sobriety test and then arrested on suspicion of DUI.

Officers then conducted a probable search of the car based on the odor of burned marijuana coming from the car. A gray and black backpack was found in the backseat on the driver’s side. When police asked who it belonged to, Juan Hugus said it was his, the complaint indicates.

The bag was searched, and officers “found a scale and a Mason jar with a large amount of marijuana in it. When it was weighed, it was 1.9 ounces, or 53.86 grams,” according to the complaint.

Also, various beverages were found inside the car, including two 12-packs of beer and other alcoholic beverages. When officers searched Juan Hugus, “an Ativan pill was found. He didn’t have a prescription for it, so it was seized as evidence,” according to the complaint.

All items were secured Officer Foust’s cruiser.

Several days later, Officer Maxwell was contacted by Juan Hugus’ mother and “she said Juan didn’t have a prescription for the Ativan pill and didn’t know why he would have one.”

According to court documents, Juan Hugus was charged January 4 with the following offenses:

  • Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony
  • Intentional Possession of a Controlled Substance By Person Not Registered, Misdemeanor
  • Possession Of Marijuana, Misdemeanor
  • Use/Possession Of Drug Paraphernalia, Misdemeanor
  • Purchase, Etc. Alcohol Beverage By A Minor, Summary

He has yet to be arraigned on the above-listed charges.

Court documents indicate Jose Hugus pleaded guilty on November 22, 2017, to underage alcohol possession and paid court costs and fines of $304.50.

Also, court documents indicate Bethany Lindsay was charged with possession of marijuana, drug paraphernalia, and alcoholic beverages. She waived her preliminary hearing and was accepted into the Accelerated Rehabilitative Disposition program on Wednesday, January 24.

No court documents were available on the driver of the vehicle or the other two passengers.
