Traffic Stop Leads to Drug Delivery Charges Against Kennerdell Teen

SUGARCREEK BOROUGH, Pa. (EYT) — A traffic stop in Sugarcreek Borough led to the arrest of a Kennerdell teen for drug and related charges.

According to a criminal complaint filed by Lt. Ashbaugh, of the Sugarcreek Borough Police Department, around 10:00 p.m. on April 22, 18-year-old Kody Alle McClung, of Kennerdell, was standing at the rear of his vehicle, a 2006 Volkswagen sedan, with the trunk open while in the left turning lane at the intersection of Front Street and Allegheny Boulevard. When the light turned green, McClung got in the driver’s seat and drove the vehicle straight across to the Sheetz parking lot.

The complaint states that Lt. Ashbaugh initiated a traffic stop and Senior Patrolman Highfield arrived at the scene a short time later.

It was learned that a call came in the previous night concerning McClung’s Volkswagen, the complaint continues.

According to the complaint, Patrolman Highfield viewed a case of beer hidden behind and under the driver’s seat. Since both individuals in the car were under the age of 21,  Lt. Ashbaugh removed the case of beer. It still had five unopened cans of beer which were still cold to the touch.

McClung was told to exit the vehicle. Lt. Ashbaugh noticed a strong smell of marijuana on McClung. McClung stated that “he smoked marijuana about two hours earlier, and the ‘roach’ was in the driver side door panel,” the complaint states.

When he attempted to show Lt. Ashbaugh where the “roach” was located, he accidentally set off a stun gun that was in the side door that appeared to be a flashlight. Lt. Ashbaugh then took McClung to the back of the car, and the passenger was ordered to leave the car, the complaint indicates.

The stun gun was retrieved, and Lt. Ashbaugh also found a set of metal knuckles in the same door as the “roach.” The open beer can was also found under McClung’s seat, was cold to the touch and about one-quarter full, the complaint continues.

McClung was then given field tests that he failed, and he was then arrested for the suspicion of DUI and other offenses, according to the complaint.

Due to McClung’s actions in the trunk before the traffic stop, the trunk was searched and a strong odor of marijuana was present. Located in a red backpack was a substantial amount of marijuana as well as baggies for packaging in smaller amounts for distribution, the complaint states.

McClung was arraigned at 12:55 p.m. on April 23 in front of Magisterial District Judge Patrick E. Lowrey on the following charges:

– Manufacture, Delivery, or Possession With Intent to Manufacture or Deliver, Felony
– Use/Possession Of Drug Paraphernalia, Misdemeanor
– Make Repairs/Sell/Etc Offensive Weapons, Misdemeanor 1
– DUI: Controlled Substance — Schedule 1 — 1st Offense
– DUI: Controlled Substance — Combination Alcohol/Drugs — 1st Offense, Misdemeanor
– Purchase Etc Alcoholic Beverage By A Minor, Summary
– Disregard Traffic Lane (Specified), Summary
– Restrictions on Alcoholic Beverages, Summary

Unable to post $25,000.00 monetary bail, McClung was lodged in the Venango County Jail.

A preliminary hearing is scheduled for 1:30 p.m. on April 26 in Venango County Central Court.
