Two Local Men Facing Charges in Forest County Dispute

FOREST CO., Pa. (EYT) — Assault and related charges have been filed against two local men stemming from an altercation that occurred along State Route 899 in Forest County.

According to court documents, Marienville-based State Police filed criminal charges in Magisterial Judge Daniel L. Miller’s office on December 28 against 47-year-old Brian Larry Popoleo, of Marienville, and 47-year-old Jason Scott Daisley, of Brookville.

State Police in Marienville received a call around 3:15 p.m. on December 14 concerning a fight that was occurring on State Route 899, approximately 3/4 mile south of Blue Ridge Road, in Barnett Township, Forest County.

According to a criminal complaint, two off-duty officers encountered the fight and separated the individuals shortly afterward.

Troopers Mort, Smith, Lantzy, and Lauer also responded to the scene.

Troopers observed the following: a black Chevrolet Silverado and a white Chevrolet Silverado parked along Route 899, Jason Daisley and Brian Popoleo separated in a kneeling position, a gray and black baseball bat, and a known woman standing away from the two defendants.

Daisley had the following injuries: bruising to the right eye; swelling around his mouth to include his lips; blood around his mouth; and abrasions on his jaw and cheek area, according to the complaint.

No injuries were reported by Popoleo or the known woman.

Both defendants were taken to PSP Marienville station for further investigation.

Popoleo gave the following statement:

He had been attempting to confront Daisley on a personal matter, and he saw him on Route 899, drove behind him to get him to pull over. Both vehicles pulled off the roadway, and the men exited their vehicles.

Popoleo stated that Dailsey was in possession of a baseball bat, so he grabbed Daisley’s arm that held the baseball bat and punched him in the face with a closed fist with his other hand.

Daisley gave the following statement:

Popoleo had followed him on December 5, attempting to get him to pull over, but Popoleo eventually turned around. Popoleo texted him later in the evening and called him an (expletive).

He left work that day (December 14), and when he turned onto Route 899, he noticed Popoleo behind him.

Previously, Popoleo would drive beside him trying to force him off the roadway, so he eventually stopped to avoid a collision.

He admitted to exiting his vehicle with a baseball bat and approaching Popoleo.

The following charges were filed against Popoleo:

– Stalking — Repeatedly Commit Acts To Cause Fear, Misdemeanor 1 (two counts)
– Simple Assault, Misdemeanor 3
– Disorderly Conduct Engage In Fighting, Misdemeanor 3
– Harassment — Subject Other to Physical Contact, Summary
– Failure To Keep Right, Summary
– Disregard Traffic Lane (Single), Summary
– Careless Driving, Summary
– Reckless Driving, Summary

Daisley faces the following charges:

– Simple Assault, Misdemeanor 3
– Disorderly Conduct Engage In Fighting, Misdemeanor 3
– Harassment — Subject Other to Physical Contact, Summary
– Restrictions on Alcoholic Beverages, Summary

Preliminary hearings have not yet been scheduled.
