Two Venango County Men Facing Felony Forgery Charges

FRANKLIN, Pa. (EYT) — Two Venango County men are facing felony forgery and related charges after allegedly conspiring to cash another person’s payroll check.

According to a criminal complaint, Dean Roman Maxwell, 36, of Franklin, allegedly stole a payroll check after it was placed for pick-up by another employee.

The complaint states that Maxwell then allegedly traveled to Oil City to get the help of 37-year-old David Valsean McMunn, and together they allegedly agreed to split the proceeds from the stolen check.

At some point, Maxwell allegedly forged a signature to appear to be the victim’s signature and then took McMunn to a bank in an attempt to cash the check, the complaint indicates.

McMunn allegedly went inside the bank and said he was the owner of the payroll check and said he’d either lost his identification or it was stolen, but the bank refused him service and asked him to return with proper identification, the complaint continues.

Maxwell then took McMunn to another bank, where McMunn allegedly attempted to cash the same forged check and was told by a bank teller the bank would cash the check as long as the owner of the bank account could identify him over the phone, according to the complaint.

McMunn allegedly stood at the counter while the teller called the account owner, who said the owner of the payroll check could not be at the bank yet because he was still working, then described the victim’s appearance and possible clothing, the complaint states.

The teller told McMunn she could not confirm his identity, and he would have to come back with identification, and McMunn allegedly left the bank, leaving the forged check with the bank teller, the complaint continues.

Based on the facts and circumstances, Patrolman Barnhill, of Franklin Police Department, filed a criminal complaint on July 7, 2015, against Maxwell on the following offenses:

  • Forgery — Unauthorized Act In Writing, Felony 2
  • Theft By Unlawful Taking-Movable Prop, Misdemeanor 1
  • Theft By Deception-False Impression, Misdemeanor 1
  • Receiving Stolen Property

Maxwell is awaiting a preliminary hearing.

Previously, McMunn was arraigned on the following charges:

  • Forgery — Alter Writing, Felony 2
  • Theft By Unlawful Taking-Movable Prop, Misdemeanor 1
  • Theft By Deception-False Impression, Misdemeanor 1
  • Receiving Stolen Property, Misdemeanor 1

A preliminary hearing for McMunn is scheduled for 1:30 p.m. today (July 8, 2015) in Venango County Central Court.
