Area Woman Pleads Guilty in Straw Firearms Purchase Case

VENANGO CO., Pa. (EYT) — An area woman has pleaded guilty to a charge of Statement Under Penalty in a case in which she was accused of making a straw firearms purchase.

A straw firearms purchase is when a person agrees to acquire a firearm for someone else who is legally unable to purchase a firearm for themselves.

According to a criminal complaint filed on November 4, 2022, an agent from the PA Office of the Attorney General and a Pennsylvania State Trooper became aware of a Rock Island Model 1911 .45 caliber pistol that was recovered from a crime. The gun was purchased by 31-year-old Amanda Lee Kuhn, of Greenville, Pa., at the Rural King store in Franklin on December 29, 2021.

The pistol was recovered by State Police 55 days later on February 22, 2022, in the possession of 27-year-old Charles Motter. Motter is a person not to possess a firearm, according to the complaint.

The gun was not reported lost or stolen by Amanda Kuhn, the complaint says.

On August 17, 2022, the OAG agent, along with an ATF agent, made contact with Kuhn at her residence in Greenville, Pa. She agreed to speak to the agents on her enclosed front porch. She was informed that she was not under arrest, was free to re-enter her home, and could ask agents to leave at any time. She indicated that she understood that she was not obligated to speak to the agents and agreed to speak to them, the complaint states.

Kuhn told the agents that Charles Motter asked her to purchase the firearm for him, to which she agreed. She said that Motter provided the funds and accompanied her to Rural King in Franklin, Pa. She stated that he pointed out the firearm for her to purchase. She indicated that she completed all of the required paperwork and that after the purchase, they traveled to her previous residence in Oil City where she transferred the firearm to him.

It was noted that Kuhn does not hold a federal firearm license nor is she a county sheriff.

Kuhn agreed to participate in a recorded interview, at which time she confirmed all of the above information.

Prior to a negotiated plea bargain, Kuhn faced the following charges:

  • Materially false written statement — purchase, delivery, transfer of a firearm, Felony 3 (two counts)
  • Conspiracy — Firearm Ownership — Duty Of Other Persons, Misdemeanor 2
  • False Swearing — Mislead Public Servant, Misdemeanor 2
  • Statement Under Penalty, Misdemeanor 3

Kuhn pleaded guilty to the third-degree misdemeanor charge of Statement Under Penalty.

As part of her guilty plea, Kuhn must repay court costs in the amount of $576.75 by December 9, 2022.
