Franklin Man Accused of Raping Teen Allegedly Tells Victim That Crying ‘Turns Him On’

SUGARCREEK, Pa. (EYT) – A Franklin man is facing charges after he allegedly raped a 15-year-old girl in June in Sugarcreek Borough, Venango County.

According to a criminal complaint, Officer Highfield, of the Sugar Creek Borough Police, received a report of a rape which allegedly occurred around June 8, 2015, in the borough.

Officer Highfield asked the 15-year-old victim to come to the police station for an interview., the complaint states.

Police were unable to get any information from the victim during that interview because she “was crying uncontrollably and was unable to be consoled,” the complaint indicates.

Police later set up a forensic interview at Children and Youth Services, which took place on August 6, the complaint continues.

During the interview, the victim said Dakota Jay Lute, 19, of Franklin, asked her to visit his residence to “hang out,” and her mother had dropped her off there. The victim said other individuals were also present at the residence, the complaint states.

She and Lute spent time in the living room of the residence before moving to Lute’s bedroom, according to the complaint.

The victim said she sat on the bed as they watched a movie, then got into a laying position and Lute put his arm around her and began kissing her, the complaint indicates.

When Lute allegedly attempted to touch her in a sexual manner, the victim said she told him to stop and said, “No.” Lute allegedly removed some of his own clothing, and the victim again said she didn’t want to do this, and Lute allegedly said “it was fine,” the complaint continues.

The victim said Lute allegedly got on top of her and had her shoulder pinned using his forearm, then removed some of her clothing. The victim said she began to cry and “he said that’s what turned him on,” the complaint states.

The victim said she kept telling Lute to stop but he allegedly continued and she didn’t scream out because she was scared. according to the complaint.

After the incident, the victim put her clothes on and asked to be taken home, but Lute remained and a relative of Lute’s drove her home, the complaint indicates.

Based on the information discovered during the interview, Officer Highfield requested a warrant of arrest be issued for Lute.

According to online court documents, Lute was arraigned at 6:00 p.m. on August 8 before District Judge Patrick Lowrey in District Court 28-03-04.

He faces the following charges:

  • Rape by forcible compulsion, first-degree felony
  • Involuntary deviate sexual intercourse by forcible compulsion, first-degree felony
  • Sexual assault, second-degree felony
  • Aggravated indecent assault without consent, second-degree felony

Unable to post $50,000.00 bail, Lute was placed in the Venango County Jail.

A preliminary hearing has been scheduled for 1:30 p.m. on August 19 in Venango County Central Court.
