Oil City Man Sentenced Up to One Year in Jail for Assaulting Officers, Probation for Terroristic Threats

VENANGO CO., Pa. (EYT) — An Oil City man was sentenced on Monday to up to one year in jail for assaulting police officers, plus a term of probation for terroristic threats and other charges.

Court documents indicate 31-year-old Mitchell James Rudolph was sentenced on Monday, February 28, to the following conditions:

Confinement:

– 75 days to 12 months of confinement on one count of Simple Assault, a second-degree misdemeanor.

Probation:

– two years of probation for one count of Simple Assault, a second-degree misdemeanor;
– five years of probation for two counts of Terroristic Threats With Intent To Terrorize Another, first-degree misdemeanors; and
– one year of probation for one count of Defiant Trespass Actual Communication To, a third-degree misdemeanor.

He is currently lodged in the Venango County Jail.

Rudolph has credit for 65 days time served.

Details of the case:

According to a criminal complaint, around 8:25 p.m. on Friday, June 12, 2020, Franklin Police were dispatched to a residence on Taylor Street for a report of a possible domestic dispute. At the scene, the officers then heard shouting from an apartment and made contact with the individuals inside.

Mitchell Rudolph showed outward signs of alcohol intoxication and was uncooperative when asked for a verbal statement, the complaint states.

Police then spoke with a known victim who reported that six large holes in the drywall of the apartment were caused by Rudolph punching the walls. The resident of the apartment then told Rudolph he needed to leave, but he allegedly refused.

After speaking with the victim, police then advised Rudolph he was under arrest. He reportedly refused to comply and pulled away and began punching and kicking the officers who attempted to handcuff him. He also attempted to lunge away from the officers, pulling them with him, nearly causing them all to fall down a set of stairs, according to the complaint.

Rudolph was screaming during the altercation, to the point that bystanders outside the apartment complex heard him. He reportedly screamed obscenities at the officers and threatened to “f****** kill” them, the complaint indicates.

When the officers attempted to place Rudolph in a patrol vehicle, he reportedly placed his feet in the door jam and refused to get inside. He was then pulled away and placed inside face-first, and then began kicking the rear driver’s door repeatedly, the complaint states.

During transport, Rudolph also reportedly threatened numerous times to “kill” and “murder” one officer, the complaint continues.

Rudolph was arraigned in front of Magisterial District Judge Matthew T. Kirtland at 8:55 a.m. on Saturday, June 13, 2020.
