Police: Area Man Charged With Aggravated Assault While DUI in Three-Vehicle Crash; Victim Transported by Helicopter

TITUSVILLE, Pa. (EYT) — An area man has been charged with a laundry list of charges that includes aggravated assault while DUI stemming from a three-vehicle crash resulting in serious injuries to a passenger.

According to court documents, the Titusville Police Department filed the following criminal charges against 28-year-old Zachary Daniel Foltz, of Spartansburg, in Magisterial District Judge Amy L. Nicols’ office on Monday, March 20:

According to a criminal complaint, on September 30, 2022, a female arrived at the Titusville Police Department to report a drunk driver.

The woman stated that the vehicle was a gray Toyota Tacoma and also provided the registration to officers. As she was about to give more information to the officers, they were dispatched by Crawford County 9-1-1 to a motor vehicle accident involving three vehicles with entrapment. The time of dispatch was 2:21 p.m., and the location was at the intersection of West Spring Street and West Walnut Street, states the complaint.

Officers arrived at the location at approx 2:23 p.m. and blocked off traffic with a police car at each side of the accident, the complaint indicates.

In the complaint, officers described the first vehicle seen being a gray Toyota pickup truck that was to the right of the roadway and appeared to have hit a fire hydrant next to 708 West Walnut Street.

The second vehicle that officers noted was a gray Volvo which was resting in the middle of the street. The third, a blue Ford, was approximately 70 feet to the west at rest in the street. The gray Toyota truck had major damage to the front end of the vehicle, the Volvo had damage to the passenger rear area, and the Blue Ford had major damage to the front end, the complaint states.

The gray Toyota was being driven by a Zachary Foltz with no other occupants in his vehicle. Foltz was advised that EMS was on its way, according to the complaint.

The driver of the Volvo was not hurt, but upset. The Ford had two occupants in the vehicle. The driver was injured, and the front seat passenger was “folded in half with her head stuck underneath the dash.” She “had bones protruding through her leg area,” the complaint indicates.

The passenger of the blue Ford was transported by Emericare to Titusville High School to be flown to Hamot Hospital by STAT MedEvac. The driver was taken by Townville Ambulance to Titusville hospital, the complaint states.

During this time, Zachary Foltz was still in this vehicle waiting on Townville Ambulance to return from the Titusville Hospital, the complaint continues.

Officers found a marijuana grinder in Foltz’s vehicle and a can of Natty 12 oz. beer. Officers indicated they could smell the scent of an alcoholic beverage coming from the truck, the complaint notes.

Foltz was then transported to the Titusville Hospital.

An officer followed the ambulance that was transporting him. Once inside the hospital, the officer advised hospital staff that if they were going to draw blood for medical purposes that he would be applying for a search warrant for it, the complaint states.

On October 3, 2022, Titusville Police was contacted by a Pa. State Trooper who is an accident reconstructionist for PSP at the Warren barracks. The trooper traveled to the Titusville Police Department to meet with an officer about the accident that occurred on September 30 involving Foltz, the complaint says.

The trooper and the officer went to the location of the accident for the purpose of determining the speed that Foltz was traveling when the accident occurred. When they finished at the accident scene, they visited Shambaugh Towing to view all vehicles involved in the crash, according to the complaint.

While looking at all vehicles in the accident, the trooper pointed out that the driver and passenger in the Ford were not wearing their seat belts. A look into Zach Foltz’s vehicle showed that Zach Foltz was not wearing his seat belt, either, the complaint states.

According to the complaint, later that day, an officer executed a search warrant at the Titusville Hospital for Zach Foltz’s blood. Blood was provided to him by the Titusville Hospital lab and was packaged and sealed by a known hospital employee. The blood was subsequently sent out to a lab.

On October 10, the officer was contacted by Titusville Public Works Director Chris Roofner. Roofner explained to the officer that the fire hydrant located at 708 West Spring Street sustained damage from the accident. Repair would cost about $5,000.00. A final bill for restitution would be sent after repairs were complete, the complaint states.

A preliminary arraignment is scheduled for Thursday, March 23, at 3:15 p.m. with Magisterial District Judge Amy L. Nicols presiding.
